Terms of Service

These Terms of Service ("Terms") represent a legally binding contract between you, the user ("Client"), and TruDials ("Company", "we", "us"), a United Kingdom registered entity. By uploading data, utilizing our platform, or remitting payment, you represent and warrant that you possess the legal authority to bind your organization to these Terms.

Governing Law and Exclusive Jurisdiction

TruDials is registered and operates under the laws of the United Kingdom. These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed strictly in accordance with the laws of England and Wales. The Client irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms.

Compliance & The Do-Not-Call (DNC) Disclaimer

TruDials PROVIDES AN INFORMATIONAL DATA HYGIENE TOOL AND DOES NOT PROVIDE FEDERAL OR STATE DO-NOT-CALL (DNC) REGISTRY SCRUBBING. TCPA COMPLIANCE, LIST LEGALITY, AND ADHERENCE TO THE TELEMARKETING SALES RULE (TSR) ARE 100% THE SOLE RESPONSIBILITY OF THE CLIENT.

We provide operational data (such as active/inactive line status and litigator trap screening) strictly for informational purposes. The Client remains entirely responsible for cross-referencing their dialer lists against National and State DNC registries prior to initiating any outreach.

Absolute Indemnification

The Client agrees to fully indemnify, defend, and hold harmless TruDials, its directors, officers, employees, and affiliates from and against ANY and ALL claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to the Client's telemarketing, dialing, or outreach practices. This absolute indemnification explicitly includes, but is not limited to, any claims alleging violations of the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), the California Consumer Privacy Act (CCPA), and any equivalent federal, state, or international telecommunication statutes.

Limitation of Liability and "As Is" Provision

All data, skip tracing, and HLR verification services are provided strictly on an "AS IS" and "AS AVAILABLE" basis. Due to the rapidly shifting nature of global telecom networks and carrier reporting delays, TruDials makes no warranties or guarantees regarding the 100% accuracy, completeness, or currentness of the returned data. To the maximum extent permitted by applicable law, TruDials’s total cumulative liability to the Client for any cause of action, whether in contract, tort, or otherwise, shall not exceed the exact monetary amount the Client paid to TruDials for the specific order giving rise to the claim.
